Grass Valley Net Wireless Service Agreement Supplement (January 25, 2006)

This agreement supplements the GV.NET TERMS AND CONDITIONS for GV.NET High speed Wireless Internet Customers. GV.NET may revise this agreement at anytime without notice. The current agreement can be found at: http://www.gv.net/forms/wireless_agreement.html

1. Grass Valley Net retains ownership of the wireless equipment. Grass Valley Net provides wireless equipment on a rental basis. For the first year, any maintenance to the customer premises equipment is included with the setup fee. After the first year, the Customer may either purchase a maintenance contract for $99/year, or the Customer will be charged for any service calls and equipment repair to their wireless installation after the warranty period of 1 year. Upon termination of wireless service, Customer agrees to allow GV.NET personnel to recover the loaned radio equipment. If Customer fails to allow recovery of the loaned radio equipment, Customer agrees to pay GV.NET the full replacement value in the amount of: $350.

2. Normally GV.NET will charge a setup fee of $399 for the installation and rental of wireless equipment terminated at a jack for the router to plug into. Occasionally, there will be installations requiring a higher installation cost, as with an unusually long distance from the access point, or other factors as determined by the installer. Installation does not include installation/configuration of the router or equipment behind the router.

3. Installation of Customer router, computer, VPN, cabling, or local area network equipment is NOT included in the setup fee. There is an extra charge of $65/hr for installation/configuration of Customer's router, computer, or network. Alternately, Customer may hire a qualified technician of their own choosing. Please provide below the name of the technician performing the installation of the router and/or local network.

4. Customer must provide a router and uptodate virus/intrusion software with firewall protection, to provide an adequate level of security from outside Internet intruders. If a wireless router is used, customer must insure that WEP encryption is enabled to prevent unauthorized network connections. This is necessary for intrusion security, and prevention of disruption of other networks.

5. Bandwidth usage: To maintain quality of service, we actively monitor bandwidth usage for each customer. For the $49/month fee, usage is limited to 3Gigs/month and .5Gig max in a single day. For 6 Gigs of traffic, please add $30/month to your fee, or $79. Above 6 Gigs, add $0.05 per MB. If you have special bandwidth needs, please contact our office.

6. Customer is responsible for the removal of any line-of-site obstacles. Wireless Internet Service requires a clear line-of-site view between stations. Customer agrees to provide tree trimming or other needed obstacle clearance on the Customer side. There may occur forseeable and unforseeable circumstances rendering wireless service unreliable, such as radio interference, weather conditions, foliage growth, building construction, etc.. Customer acknowledges that such issues could arise and are not the responsibility of GV.NET.

7. Customer is responsible for maintaining their computers uncompromised by viruses, worms, trojan horses, platforms, or other intrusive, disruptive, or otherwise malicious software. In the event that any disruption, denial of service attack, spamming incident, suspicious, inappropriate network activity is detected, GV.NET may at their total discretion cancel service at any time without prior notice. In instances of repeat occurances, or where the Customer has previously been made aware of a compromised computer on their network, GVNET may at their option impose engineering fees of $85/hour for engineering management of damages resulting from activity such as described in this paragraph.
